Indigenous Lawsuit Challenges Mexico’s Mining Law

On November 15, the indigenous  community of San Miguel filed a legal complaint against the Mexican government over the granting of mining concessions to Hochschild Mining within its territory, claiming that these concession violate the Mexican Constitution and international treaties that the Mexican State has ratified.

The complaint argues that the concessions contravene the collective right to property of indigenous territory, the constitutional right to the full protection of indigenous lands, the right to consultation, the guarantees of legality and legal certainty, and the right to the protection of communal lands.

Moreover, the complaint requests the court determine whether the current Mining Law, which determines how concessions are granted, is compatible with the Constitution and with international treaties.

In recent years, the Mexican government has granted roughly 30 mining concessions in the Montaña and Costa Chica regions of Guerrero, without regard for the rights of the Naua, Me’phaa and Na Savi indigenous peoples. The concessions granted in the Montaña cover about one third of the region’s area.
